Bununla birlikte; kamu hizmetinin tarafs\u0131zl\u0131\u011f\u0131, liyakat ve devlet otoritesinin korunmas\u0131 amac\u0131yla belirli s\u0131n\u0131rlamalara tabidir. Bu s\u0131n\u0131rlamalar\u0131n en somut dayana\u011f\u0131 4688 say\u0131l\u0131 Kamu G\u00f6revlileri Sendikalar\u0131 ve Toplu S\u00f6zle\u015fme Kanunu\u2019nun 15. maddesidir.<\/p>\n\n\n\n<p>S\u00f6z konusu maddenin (c) bendi; m\u00fcste\u015farlar, genel m\u00fcd\u00fcrler, daire ba\u015fkanlar\u0131, il ve il\u00e7e te\u015fkilatlar\u0131n\u0131n en \u00fcst amirleri ile bunlar\u0131n yard\u0131mc\u0131lar\u0131n\u0131n ve 100\u2019den fazla personelin \u00e7al\u0131\u015ft\u0131\u011f\u0131 kurumlar\u0131n amir ve yard\u0131mc\u0131lar\u0131n\u0131n sendika \u00fcyesi olamayacaklar\u0131n\u0131 a\u00e7\u0131k\u00e7a h\u00fckme ba\u011flam\u0131\u015ft\u0131r. Bu yasak, kamu g\u00fcc\u00fcn\u00fc kullanan ve \u201ci\u015fveren temsilcisi\u201d s\u0131fat\u0131 ta\u015f\u0131yan y\u00f6neticilerin, sendikal rekabetin taraf\u0131 olmas\u0131n\u0131 engellemeyi ve kamu hizmetindeki hiyerar\u015fik d\u00fczenin tarafs\u0131zl\u0131\u011f\u0131n\u0131 korumay\u0131 ama\u00e7lamaktad\u0131r.<\/p>\n\n\n\n<p>Buna kar\u015f\u0131n, Tar\u0131m ve Ormanc\u0131l\u0131k Hizmet Kolu ba\u015fta olmak \u00fczere bir\u00e7ok kurumda ya\u015fanan s\u00fcre\u00e7ler \u015fu ciddi hukuki ve mali sorunlar\u0131 beraberinde getirmektedir. Tar\u0131m ve Orman Bakanl\u0131\u011f\u0131 ile ba\u011fl\u0131 kurulu\u015flar\u0131nda g\u00f6rev yapan \u0130l M\u00fcd\u00fcrleri, B\u00f6lge M\u00fcd\u00fcrleri ve yard\u0131mc\u0131lar\u0131 gibi 15. madde kapsam\u0131nda a\u00e7\u0131k\u00e7a yasakl\u0131 olan bir\u00e7ok y\u00f6neticinin, mevzuata ayk\u0131r\u0131 \u015fekilde sendika \u00fcyeliklerini s\u00fcrd\u00fcrd\u00fckleri ve hatta sendikalar\u0131n karar organlar\u0131nda g\u00f6rev ald\u0131klar\u0131 tespit edilmi\u015ftir. 08\/05\/2024 tarihli ve 7547 say\u0131l\u0131 Kanun ile yap\u0131lan son d\u00fczenleme sonras\u0131 bu yasaklar g\u00fcncelli\u011fini korumas\u0131na ra\u011fmen, bir\u00e7ok kurumda \u00fcyeliklerin sonland\u0131r\u0131lmas\u0131na dair somut bir ad\u0131m at\u0131lmam\u0131\u015ft\u0131r.<\/p>\n\n\n\n<p>Bunun yan\u0131 s\u0131ra sendika \u00fcyesi olmas\u0131 hukuken m\u00fcmk\u00fcn olmayan bu ki\u015filere, \u00fcyeliklerine istinaden kamu kaynaklar\u0131ndan \u201ctoplu s\u00f6zle\u015fme ikramiyesi\u201d \u00f6denmektedir. Hak edilmeyen bu \u00f6demeler, hem kamu maliyesine ek bir y\u00fck getirmekte hem de mevzuata uygun davranan kamu g\u00f6revlileri aleyhine haks\u0131z bir menfaat ili\u015fkisi yaratmaktad\u0131r. Hazine ve Maliye Bakanl\u0131\u011f\u0131\u2019n\u0131n bu haks\u0131z \u00f6demeleri durdurma ve r\u00fccu etme y\u00fck\u00fcml\u00fcl\u00fc\u011f\u00fc bulunmaktad\u0131r. Devlet Personel Ba\u015fkanl\u0131\u011f\u0131\u2019n\u0131n yerle\u015fik g\u00f6r\u00fc\u015flerine g\u00f6re, sendika \u00fcyesi bir personelin yasakl\u0131 bir kadroya vekaleten atanmas\u0131 \u00fcyeli\u011fi sona erdirmese de bu ki\u015filerin vekalet s\u00fcresince hi\u00e7bir sendikal faaliyete kat\u0131lamayaca\u011f\u0131 ve sendikalar aras\u0131nda ayr\u0131mc\u0131l\u0131k yapamayaca\u011f\u0131 esast\u0131r. Ancak uygulamada, bu kadrolar\u0131 vekaleten y\u00fcr\u00fcten personelin \u201ci\u015fveren vekili\u201d s\u0131fat\u0131yla sendikal s\u00fcre\u00e7lere m\u00fcdahil oldu\u011fu ve tarafs\u0131zl\u0131k ilkesini zedeledi\u011fi g\u00f6r\u00fclmektedir.<\/p>\n\n\n\n<p>Ayr\u0131ca sendika \u00fcyesi olamayacak ki\u015filerin bu yasaklara ayk\u0131r\u0131 davranmas\u0131, sadece disiplin hukukunu de\u011fil, ayn\u0131 zamanda T\u00fcrk Ceza Kanunu ve Bor\u00e7lar Kanunu kapsam\u0131nda mali ve cezai sorumluluklar\u0131 da beraberinde getirmektedir. Bu ki\u015filerin tespit edilmemesi ve gerekli i\u015flemlerin yap\u0131lmamas\u0131, ilgili bakanl\u0131klar\u0131n denetim g\u00f6revini ihmal etmesi anlam\u0131na gelmektedir.<\/p>\n\n\n\n<p>Sonu\u00e7 olarak; Anayasa Mahkemesi kararlar\u0131 ve y\u00fcr\u00fcrl\u00fckteki mevzuat \u00e7er\u00e7evesinde, kamu y\u00f6netiminde liyakatin tesisi, sendikal \u00f6zg\u00fcrl\u00fcklerin suistimal edilmemesi ve kamu kaynaklar\u0131n\u0131n usuls\u00fcz kullan\u0131m\u0131n\u0131n engellenmesi amac\u0131yla bu konudaki teredd\u00fctlerin giderilmesi ve yasal yapt\u0131r\u0131mlar\u0131n uygulanmas\u0131 bir zorunluluktur.<\/p>\n\n\n\n<p>Bu ba\u011flamda;<\/p>\n\n\n\n<p>1. Bakanl\u0131\u011f\u0131n\u0131z b\u00fcnyesinde ve ta\u015fra te\u015fkilat\u0131nda g\u00f6rev yapan \u0130l M\u00fcd\u00fcr\u00fc, \u0130l M\u00fcd\u00fcr Yard\u0131mc\u0131s\u0131, B\u00f6lge M\u00fcd\u00fcr\u00fc ve \u0130\u015fletme M\u00fcd\u00fcr\u00fc unvanl\u0131 personelden ka\u00e7\u0131 herhangi bir kamu g\u00f6revlileri sendikas\u0131na \u00fcyedir?&nbsp;<\/p>\n\n\n\n<p>2. 4688 say\u0131l\u0131 Kanun\u2019un 15. maddesinin (c) bendinde 7547 say\u0131l\u0131 Kanun ile yap\u0131lan son d\u00fczenleme uyar\u0131nca, sendika \u00fcyesi olmas\u0131 yasaklanan personelin \u00fcyeliklerinin iptali i\u00e7in Bakanl\u0131\u011f\u0131n\u0131zca bir \u00e7al\u0131\u015fma ba\u015flat\u0131lm\u0131\u015f m\u0131d\u0131r?&nbsp;<\/p>\n\n\n\n<p>3. Sendika \u00fcyesi olmas\u0131 yasaklanan ancak \u00fcyeli\u011fi devam eden kamu g\u00f6revlilerine bug\u00fcne kadar toplam ne kadar &#8220;toplu s\u00f6zle\u015fme ikramiyesi&#8221; \u00f6denmi\u015ftir? Bu haks\u0131z \u00f6demelerin r\u00fccu edilmesi\/tahsili planlanmakta m\u0131d\u0131r?&nbsp;<\/p>\n\n\n\n<p>4. Sendika \u00fcyesi olamayacak kadrolarda bulunmas\u0131na ra\u011fmen sendika y\u00f6netim kurullar\u0131nda g\u00f6rev alan personel hakk\u0131nda 657 say\u0131l\u0131 Kanun veya T\u00fcrk Ceza Kanunu uyar\u0131nca ba\u015flat\u0131lm\u0131\u015f bir idari veya adli soru\u015fturma bulunmakta m\u0131d\u0131r?&nbsp;<\/p>\n\n\n\n<p>5. Vekaleten veya tedviren bu kadrolara atanan personelin, g\u00f6rev s\u00fcreleri boyunca sendikal faaliyetlere kat\u0131ld\u0131klar\u0131na dair Bakanl\u0131\u011f\u0131n\u0131za ula\u015fan bir \u015fikayet bulunmakta m\u0131d\u0131r?&nbsp;<\/p>\n\n\n\n<p><\/p>\n\n\n\n<p><\/p>\n\n\n\n<p><\/p>\n\n\n\n<p><strong>T\u00dcRK\u0130YE B\u00dcY\u00dcK M\u0130LLET MECL\u0130S\u0130 BA\u015eKANLI\u011eI\u2019NA<\/strong><\/p>\n\n\n\n<p>A\u015fa\u011f\u0131daki sorular\u0131m\u0131n <strong>Tar\u0131m ve Orman Bakan\u0131 \u0130brahim YUMAKLI<\/strong> taraf\u0131ndan Anayasa\u2019n\u0131n 98. ve \u0130\u00e7t\u00fcz\u00fc\u011f\u00fcn 96. ve 99. maddeleri gere\u011fince yaz\u0131l\u0131 olarak cevapland\u0131r\u0131lmas\u0131n\u0131 sayg\u0131lar\u0131mla arz ederim.<\/p>\n\n\n\n<p><strong>\u0130brahim AKIN<\/strong>\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0<\/p>\n\n\n\n<p><strong>\u0130zmir Milletvekili<\/strong><\/p>\n\n\n\n<p>Tar\u0131m ve K\u0131rsal Kalk\u0131nmay\u0131 Destekleme Kurumu (TKDK), Avrupa Birli\u011fi ve uluslararas\u0131 kurulu\u015flardan sa\u011flanan fonlar\u0131n k\u0131rsal kalk\u0131nma projelerinde kullan\u0131lmas\u0131n\u0131 sa\u011flamak amac\u0131yla stratejik bir \u00f6neme sahiptir. Kurum, IPARD I ve II d\u00f6nemlerinde %99\u2019un \u00fczerinde fon kullan\u0131m oran\u0131yla T\u00fcrkiye\u2019yi en ba\u015far\u0131l\u0131 \u00fclke konumuna ta\u015f\u0131m\u0131\u015f, 105 bin ki\u015fiye istihdam sa\u011flanmas\u0131na \u00f6nc\u00fcl\u00fck etmi\u015ftir.<\/p>\n\n\n\n<p>Ancak, Tar\u0131m Orkam-Sen taraf\u0131ndan haz\u0131rlanan \u201cTKDK \u00c7al\u0131\u015ftay\u0131 Sonu\u00e7 Raporu\u201dnda da belirtildi\u011fi \u00fczere; kurumun bu ba\u015far\u0131s\u0131n\u0131n mimar\u0131 olan personelin hukuki stat\u00fcs\u00fc, mali ve \u00f6zl\u00fck haklar\u0131 konusunda ciddi ma\u011fduriyetler ya\u015fanmaktad\u0131r. Personel, 657 say\u0131l\u0131 Kanun ve ilgili mevzuat\u0131n sa\u011flad\u0131\u011f\u0131 g\u00fcvencelerden yararlanamamakta, \u201c\u0130dari Hizmet S\u00f6zle\u015fmesi\u201d ile belirsiz bir stat\u00fcde \u00e7al\u0131\u015ft\u0131r\u0131lmaktad\u0131r. \u00d6zellikle \u201c\u0130dari Uzman\u201d kadrosuna ge\u00e7irilen personelin maa\u015flar\u0131nda yar\u0131 yar\u0131ya d\u00fc\u015f\u00fc\u015f ya\u015fand\u0131\u011f\u0131, personelin en d\u00fc\u015f\u00fck memur maa\u015f\u0131n\u0131n dahi alt\u0131nda \u00fccretlendirildi\u011fi tespit edilmi\u015ftir. Ayr\u0131ca kurum personelinin kamu g\u00f6revlisi s\u0131fat\u0131 ta\u015f\u0131mas\u0131na ra\u011fmen Ye\u015fil Pasaport hakk\u0131ndan yararlanamad\u0131\u011f\u0131 ve harc\u0131rah \u00f6demelerinde kendi ceplerinden harcama yapmak zorunda kald\u0131klar\u0131 raporda vurgulanm\u0131\u015ft\u0131r.<\/p>\n\n\n\n<p>K\u0131rsal kalk\u0131nma hamlesinin s\u00fcrd\u00fcr\u00fclebilirli\u011fi, kurum \u00e7al\u0131\u015fanlar\u0131n\u0131n i\u015f g\u00fcvencesinin sa\u011flanmas\u0131 ve mali hak kay\u0131plar\u0131n\u0131n giderilmesiyle m\u00fcmk\u00fcnd\u00fcr.<\/p>\n\n\n\n<p><strong>Bu ba\u011flamda;<\/strong><\/p>\n\n\n\n<ol class=\"wp-block-list\">\n<li>TKDK personelinin idari hizmet s\u00f6zle\u015fmesi ile \u00e7al\u0131\u015ft\u0131r\u0131lmas\u0131ndan kaynakl\u0131 stat\u00fc belirsizli\u011fini ortadan kald\u0131rmak amac\u0131yla, \u00e7al\u0131\u015fanlar\u0131n 657 say\u0131l\u0131 Devlet Memurlar\u0131 Kanunu kapsam\u0131na al\u0131narak kadrolu ve g\u00fcvenceli istihdama ge\u00e7irilmesi y\u00f6n\u00fcnde Bakanl\u0131\u011f\u0131n\u0131zca y\u00fcr\u00fct\u00fclen bir \u00e7al\u0131\u015fma var m\u0131d\u0131r?<\/li>\n\n\n\n<li>Mart 2022\u2019de k\u0131smi zamanl\u0131 \u00e7al\u0131\u015fmadan tam zamanl\u0131 \u00e7al\u0131\u015fmaya ge\u00e7en \u201c\u0130dari Uzman\u201d unvanl\u0131 personelin maa\u015flar\u0131n\u0131n, artmas\u0131 beklenirken yar\u0131 yar\u0131ya d\u00fc\u015f\u00fcr\u00fclerek (o d\u00f6nemin rakamlar\u0131yla 15.700 TL\u2019den 8.200 TL\u2019ye) en d\u00fc\u015f\u00fck memur maa\u015f\u0131na sabitlendi\u011fi iddialar\u0131 do\u011fru mudur?<\/li>\n\n\n\n<li>Ayn\u0131 kurumda benzer i\u015fi yapan, proje inceleme ve \u00f6deme i\u015flemlerini y\u00fcr\u00fcten \u0130dari Uzmanlar\u0131n, di\u011fer uzmanlardan ve hatta kurumdaki i\u015f\u00e7i stat\u00fcs\u00fcndeki personelden daha d\u00fc\u015f\u00fck \u00fccret almas\u0131n\u0131n yaratt\u0131\u011f\u0131 \u201cE\u015fit \u0130\u015fe E\u015fit \u00dccret\u201d ilkesine ayk\u0131r\u0131 durumun d\u00fczeltilmesi i\u00e7in bir d\u00fczenleme yap\u0131lacak m\u0131d\u0131r?<\/li>\n\n\n\n<li>TKDK uzmanlar\u0131n\u0131n mali ve sosyal haklar\u0131 belirlenirken daha \u00f6nce \u201cBa\u015fbakanl\u0131k Uzmanlar\u0131\u201d emsal al\u0131n\u0131rken, Cumhurba\u015fkanl\u0131\u011f\u0131 H\u00fck\u00fcmet Sistemi sonras\u0131 emsalin \u201cAdalet Uzmanlar\u0131\u201d olarak de\u011fi\u015ftirilmesiyle olu\u015fan mali hak kay\u0131plar\u0131n\u0131n (ikramiye, giyim yard\u0131m\u0131 vb.) telafi edilmesi d\u00fc\u015f\u00fcn\u00fclmekte midir?<\/li>\n\n\n\n<li>Kamu g\u00f6revi y\u00fcr\u00fcten ve AB fonlar\u0131n\u0131n y\u00f6netiminde kritik rol oynayan TKDK personelinin, 5682 say\u0131l\u0131 Pasaport Kanunu\u2019nda yap\u0131lacak bir d\u00fczenleme ile Hususi Damgal\u0131 (Ye\u015fil) Pasaport hakk\u0131ndan yararland\u0131r\u0131lmas\u0131na y\u00f6nelik bir giri\u015fiminiz olacak m\u0131d\u0131r?<\/li>\n\n\n\n<li>Kurum personelinin uzun s\u00fcreli ge\u00e7ici g\u00f6revlendirmelerinde, ilk 10 g\u00fcnden sonra harc\u0131rah\u0131n yar\u0131ya d\u00fc\u015fmesi nedeniyle konaklama ve yemek masraflar\u0131n\u0131 kendi ceplerinden kar\u015f\u0131lad\u0131klar\u0131 belirtilmektedir. Personelin g\u00f6rev s\u0131ras\u0131nda maddi kayba u\u011framas\u0131n\u0131 engelleyecek (TMO ve \u0130ller Bankas\u0131 \u00f6rneklerinde oldu\u011fu gibi) bir d\u00fczenleme yapmay\u0131 planl\u0131yor musunuz?<\/li>\n\n\n\n<li>Uzman personelin g\u00f6rev tan\u0131mlar\u0131 d\u0131\u015f\u0131nda, can g\u00fcvenli\u011fi riski ta\u015f\u0131yan haciz ve tahsilat gibi icrai i\u015flemleri yapmaya zorland\u0131\u011f\u0131 do\u011fru mudur?
