Kamusal e\u011fitim alan\u0131 olan okullar\u0131n, dini mek\u00e2nlarla ikame edilmesi, idari g\u00fcc\u00fcn belirli bir inan\u00e7 grubunun lehine kullan\u0131lmas\u0131 demektir. Ge\u00e7mi\u015f uygulamalar g\u00f6stermi\u015ftir ki &#8220;g\u00f6n\u00fcll\u00fcl\u00fck&#8221; ibaresi ka\u011f\u0131t \u00fczerinde kalmakta, kat\u0131lmayan \u00f6\u011frenciler \u00fczerinde bir d\u0131\u015flanma riski olu\u015fmaktad\u0131r.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cG\u00f6n\u00fcll\u00fcl\u00fck\u201d denilerek kurulan bu d\u00fczenekte as\u0131l tehlike ise, etkinli\u011fe kat\u0131lmayan \u00e7ocuklar\u0131n, okulun asli ak\u0131\u015f\u0131ndan d\u0131\u015flanma, alternatif e\u011fitimsel imk\u00e2ndan mahrum kalma ve yaftalanma riskiyle kar\u015f\u0131 kar\u015f\u0131ya b\u0131rak\u0131lmas\u0131d\u0131r. Bu, yaln\u0131zca laiklik ihlali de\u011fil, ayn\u0131 zamanda e\u011fitim hakk\u0131n\u0131n dinsel kat\u0131l\u0131m \u00fczerinden fiilen ko\u015fulland\u0131r\u0131lmas\u0131d\u0131r.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Anayasal ve Yasal Dayanaklar\u0131n \u0130hlali<\/strong><strong><\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Devlet, Anayasan\u0131n 2 ve 24. Maddeleri uyar\u0131nca t\u00fcm inan\u00e7 gruplar\u0131na kar\u015f\u0131 e\u015fit mesafede durmak ve e\u011fitim hizmetini bu tarafs\u0131zl\u0131k i\u00e7inde y\u00fcr\u00fctmek zorundad\u0131r. E\u011fitim faaliyetlerinin ibadethanelere ta\u015f\u0131nmas\u0131, devletin inan\u00e7 alan\u0131ndaki tarafs\u0131zl\u0131\u011f\u0131n\u0131 zedeler. Bu uygulama laiklik ilkesini fiilen ortadan kald\u0131r\u0131r.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u00d6te yandan &nbsp;e\u011fitim faaliyetlerinin planlanmas\u0131 ve icras\u0131 MEB\u2019in ve okullar\u0131n yetkisindedir; bu yetkinin dini kurumlarla payla\u015f\u0131lmas\u0131 kanunun ruhuna ayk\u0131r\u0131d\u0131r.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Pedagojik Riskler ve Ayr\u0131mc\u0131l\u0131k Tehlikesi<\/strong><strong><\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">&#8220;De\u011ferler e\u011fitimi&#8221; ad\u0131 alt\u0131nda sunulan bu faaliyetler, de\u011ferlerin ya\u015fat\u0131laca\u011f\u0131 tek yerin camiler oldu\u011fu alg\u0131s\u0131n\u0131 yaratmaktad\u0131r. Oysa evrensel insani de\u011ferler, bilimde, sanatta, sporda ve okulun her k\u00f6\u015fesinde ya\u015fat\u0131lmal\u0131d\u0131r.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Bu uygulama ayn\u0131 zamanda bir \u00f6tekile\u015ftirme faaliyetidir. \u00c7\u00fcnk\u00fc farkl\u0131 inan\u00e7lara sahip veya herhangi bir inanc\u0131 benimsemeyen ailelerin \u00e7ocuklar\u0131, bu uygulama ile &#8220;az\u0131nl\u0131k&#8221; konumuna d\u00fc\u015f\u00fcr\u00fclmekte ve arkada\u015flar\u0131 aras\u0131nda bir ayr\u0131mc\u0131l\u0131k duygusuyla ba\u015f ba\u015fa b\u0131rak\u0131lmaktad\u0131r.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Devletin E\u011fitim Eliyle Dini Mek\u00e2na Y\u00f6nlendirme Yetkisi Yoktur<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Bir devlet okulu, \u00f6\u011frencisini camiye, kiliseye, cemevine ya da herhangi bir inan\u00e7 mek\u00e2n\u0131na, \u201cde\u011ferler e\u011fitimi\u201d veya \u201c\u015fenlik\u201d ba\u015fl\u0131\u011f\u0131 alt\u0131nda y\u00f6nlendiremez. \u00c7\u00fcnk\u00fc devletin g\u00f6revi inanc\u0131 \u00f6rg\u00fctlemek de\u011fil, \u00f6zg\u00fcrl\u00fc\u011f\u00fc g\u00fcvence alt\u0131na almakt\u0131r.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Camiler, ku\u015fkusuz toplumun dinsel ve k\u00fclt\u00fcrel ya\u015fam\u0131nda yeri olan ibadet mek\u00e2nlar\u0131d\u0131r. Ancak \u201cde\u011ferler\u201din ya\u015fat\u0131laca\u011f\u0131 yeg\u00e2ne kamusal alan camiler de\u011fildir. De\u011ferler, okulda, k\u00fct\u00fcphanede, bilim merkezinde, tiyatro salonunda, m\u00fczede, parkta, spor alan\u0131nda, dayan\u0131\u015fma etkinliklerinde, sanat \u00fcretiminde ve demokratik ortak ya\u015fam pratiklerinde de \u00fcretilir, aktar\u0131l\u0131r ve g\u00fc\u00e7lenir. \u00c7ocuklara ahlaki ve toplumsal de\u011ferleri \u00f6\u011fretmenin yolu, onlar\u0131 devlet eliyle bir ibadet mek\u00e2n\u0131na sevk etmek de\u011fil, \u00f6zg\u00fcr, \u00e7o\u011fulcu, ele\u015ftirel ve e\u015fitlik\u00e7i bir e\u011fitim ortam\u0131 kurmakt\u0131r.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">MEB\u2019in bu yaz\u0131s\u0131 ise tam tersine, devletin t\u00fcm \u00f6\u011frencileri inanc\u0131, mezhebi, d\u00fcnya g\u00f6r\u00fc\u015f\u00fc ne olursa olsun S\u00fcnni-Hanefi \u0130slam referansl\u0131 bir kamusal sembolizme do\u011fru y\u00f6nlendirdi\u011fini g\u00f6stermektedir.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Kat\u0131lmayan \u00c7ocuklar\u0131n E\u011fitim Hakk\u0131 Risk Alt\u0131ndad\u0131r<\/strong><strong><\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Anayasa\u2019n\u0131n 42. maddesi uyar\u0131nca kimse e\u011fitim ve \u00f6\u011frenim hakk\u0131ndan yoksun b\u0131rak\u0131lamaz. Oysa bu uygulaman\u0131n en a\u011f\u0131r sonu\u00e7lar\u0131ndan biri de, camilerde d\u00fczenlenecek \u201cy\u0131lsonu \u015fenlikleri\u201dne kat\u0131lmak istemeyen ya da ailesi taraf\u0131ndan kat\u0131l\u0131m\u0131 uygun g\u00f6r\u00fclmeyen \u00e7ocuklar\u0131n e\u011fitim hakk\u0131n\u0131n fiilen zedelenmesi ihtimalidir.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u00c7\u00fcnk\u00fc okul eliyle organize edilen, okul y\u00f6netimleri taraf\u0131ndan duyurulan ve \u00f6\u011fretmenlerin g\u00f6zetiminde y\u00fcr\u00fct\u00fclen her etkinlik, \u00f6\u011frenciler bak\u0131m\u0131ndan s\u0131radan bir \u201cserbest zaman faaliyeti\u201d de\u011fil; do\u011frudan do\u011fruya e\u011fitim ortam\u0131n\u0131n bir uzant\u0131s\u0131 olarak alg\u0131lan\u0131r. B\u00f6yle bir durumda etkinli\u011fe kat\u0131lmayan \u00e7ocuklar\u0131n ders saatleri i\u00e7inde e\u011fitim s\u00fcrecinden ayr\u0131\u015ft\u0131r\u0131lmas\u0131, e\u015fde\u011fer ve nitelikli bir alternatif etkinlikten mahrum b\u0131rak\u0131lmas\u0131, okul i\u00e7inde \u201cayr\u0131\u015fan\u201d, \u201cuyumsuz\u201d ya da \u201ckat\u0131lmayan\u201d \u00f6\u011frenci olarak i\u015faretlenmesi, yoklama, devams\u0131zl\u0131k veya dolayl\u0131 idari bask\u0131 alt\u0131nda hissetmesi, akran gruplar\u0131 ve \u00f6\u011fretmen ili\u015fkileri i\u00e7inde d\u0131\u015flanma riski ya\u015famas\u0131 gibi sonu\u00e7larla kar\u015f\u0131 kar\u015f\u0131ya kalmas\u0131 kuvvetle muhtemeldir.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Bu nedenle burada yaln\u0131zca din ve vicdan \u00f6zg\u00fcrl\u00fc\u011f\u00fc de\u011fil, ayn\u0131 zamanda e\u011fitim hakk\u0131na e\u015fit ve ayr\u0131mc\u0131l\u0131ktan uzak bi\u00e7imde eri\u015fim hakk\u0131 da tart\u0131\u015fma konusudur. Bir \u00e7ocu\u011fun kamusal e\u011fitim hakk\u0131, herhangi bir dinsel mek\u00e2nda d\u00fczenlenen etkinli\u011fe kat\u0131lma iradesine ba\u011flanamaz; do\u011frudan ya da dolayl\u0131 bi\u00e7imde ko\u015fulland\u0131r\u0131lamaz.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Dahas\u0131, \u00e7ocuklar\u0131n \u00fcst\u00fcn yarar\u0131 ilkesi gere\u011fi, e\u011fitim idaresinin g\u00f6revi \u00f6\u011frencileri inan\u00e7 temelli tercihler nedeniyle ayr\u0131\u015ft\u0131rmak de\u011fil, hi\u00e7bir \u00f6\u011frencinin kendisini d\u0131\u015flanm\u0131\u015f, eksik, \u201c\u00f6teki\u201d ya da cezaland\u0131r\u0131lm\u0131\u015f hissetmeyece\u011fi bir okul ortam\u0131 yaratmakt\u0131r.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Bir \u00f6\u011frencinin e\u011fitim hakk\u0131, camide d\u00fczenlenen bir etkinli\u011fe kat\u0131lma iradesine ba\u011flanamaz; devlet okulu, ibadet mek\u00e2n\u0131na gitmeyen \u00e7ocu\u011fu eksilten, ay\u0131ran ya da dolayl\u0131 bi\u00e7imde cezaland\u0131ran bir d\u00fczene d\u00f6n\u00fc\u015ft\u00fcr\u00fclemez.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Sonu\u00e7 olarak;<\/strong><strong><\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">MEB Din \u00d6\u011fretimi Genel M\u00fcd\u00fcrl\u00fc\u011f\u00fc\u2019n\u00fcn bu yaz\u0131s\u0131, okulu ve e\u011fitimi cami odakl\u0131 bir yap\u0131ya d\u00f6n\u00fc\u015ft\u00fcrme gayretidir. E\u011fitim, dini vak\u0131f veya ba\u015fkanl\u0131klar\u0131n insiyatifine terk edilemeyecek kadar hayati bir kamu hizmetidir.
